Judge rules against Churchill
One of the most controversial court cases to sweep the USA in recent weeks is now at a close. This week, Chief Denver District Judge Larry Naves ruled that professor Ward Churchill did not have a right to return to his job at the University of Colorado.
Not only that, but Naves also ordered that Churchill would receive no money in damages. The former professor had been trying to claim damages, saying that his dismissal from the University of Colorado was a violation of his First Amendment rights.
Churchill had been dismissed after an uproar caused by his essay, which included a comparison of 9/11 victims to Nazi Adolf Eichmann. According to the CU, Churchill was dismissed for research misconduct, including plagiarism and fabrication.
The case had already been put before a jury, who had voted that Churchill should not be reinstated. Upon appeal, Judge Larry Nixon echoed the verdict, adding that: “If I am required to enter an order that is ‘consistent with the jury’s findings,’ I cannot order a remedy that ‘disregard the jury’s implicit finding’ that Professor Churchill has suffered no actual damages that an award of reinstatement would prospectively remedy.”
